House sitters in the UK who are looking for house sitting services to stay in their homes while the owners are away can connect with Pet Lodger, through an introduction service (collectively, the Services). The Pet Lodger website, located at https://petlodger.co.uk/ (Site), offers the Services.

1. Contract

(a) Each person, organization, or entity utilizing the Services (referred to as User) and Pet Lodger, its directors, officers, employees, successors, and assignees shall constitute a binding legal agreement under these House Sitter Terms and Conditions (Terms). Each User agrees to abide by and be legally bound by these Terms by using the Site and Services. Kindly carefully read the terms. The User is encouraged to utilize the contact information provided at the conclusion of these Terms to get in touch with Pet Lodger if they have any issues.

(b) The way in which the User utilizes the Site and the Services reveals that:

(i) The User has had ample time to review the Terms and get in touch with Pet Lodger;

(ii) The User acknowledges having read, agreed to, and will abide by the Terms;

(iii) The User possesses the necessary legal ability to sign a contract for house sitting services.

(iv) The User has reached the age of eighteen.

The User is not authorized to use any of the Services if this is incorrect or if the User disagrees with these Terms

(c) These Terms are subject to change at any moment and without notice. Any use of our services after such modifications will be taken as the User's affirmation of their acceptance. Before using the Services further, Pet Lodger advises Users to review the most recent Terms. The agents, employees, and third parties of Pet Lodger are not authorised to alter the Terms.

(d) The Pet Lodger policies and terms and conditions, including without limitation the Website Terms of Use and Privacy Policy provided on the Site, are supplemented and incorporated by these Terms.

(e) The User is likewise liable for:

(i) the PayPal Terms of Service, which include the User Agreement among other things; and

(ii) The Terms & Conditions of SumUp.

(f) How Pet Lodger gathers, utilizes, and safeguards user personal information is outlined in its privacy policy. The terms of use for the Pet Lodger website control how you use the site. The Site has these documents available.

2.Introductory Service Only

(a)The Site and the Services offer a platform for online introduction for UK homeowners (Owners) and house sitters (Sitters) that allows them to:

(i)House sitters will have the opportunity to register on the site and post a profile announcing their availability to sit (Sitting Services);

(ii) get in touch with Owners via the Site's message system; and

(iii) Owners can examine the profiles of Sitters, make their own home sitting advertisements (Owner Advertisements) on the website to promote chances for a Sitter to house sit, use their vehicle, if necessary, request sitting services, and/or get in touch with a Sitter via the website's messaging system.

(b) In addition to any other applicable terms and conditions, a sitter must include all pertinent information in a sitter profile, including when and where they can offer the sitter service.

(c) An Owner shall include in an Owner Advertisement all pertinent information, including the location of the Sitting Services to be rendered, the time and day that the Owner would like the Sitting Services to be rendered, and any other terms and conditions that may be relevant. In addition, as mentioned above, an Owner contacting a Sitter directly to request Sitting Services must include all pertinent information in their correspondence.

(d) Using the message system on the Site, an Owner can get in touch with a Sitter for the Sitting Services.

(e) Each User must register and provide the necessary information in order to become a member of the site.

(f) An Owner has the ability to peruse the profiles of Sitters and initiate communication with them through the on-site messaging system in order to schedule meetings.

(g) A Sitter has access to the Owner Advertisements and can use the on-site message system to get in touch with the Owner to schedule an appointment.

(h) Every User acknowledges and accepts that the Site is merely an online introduction platform and that Pet Lodger’s obligations are restricted to making the Site and the Services available.

(i) Pet Lodger may offer a home sitting agreement template to outline the specifics of the house sit at the request of an Owner or Sitter. It is not required of owners or sitters to utilize the house sitting agreement template. Pet Lodger is clearly and explicitly not a member of any such arrangement and does not take responsibility for the efficacy or validity of any such agreement or form.

(j) In any arrangement made between an Owner and a Sitter, Pet Lodger is a party, acting as a booking agency or referral service, and offering such services. Pet Lodger has actively been involved in the process of connecting sitters with job opportunities and is contemplating continuing this practice for certain sitters through a potential subsidiary.

(k) Any agreement made between a Sitter and an Owner is private and only between the two parties. It is clearly and unequivocally not covered by the terms of the User's contract with Pet Lodger.

3.Online Registration

As an unregistered user of the Site, a User may explore and view Sitter Profiles, Owner Advertisements, and the Site. To use certain services and features on the website, such as the ability to create a Sitter Profile or an Owner Advertisements for Owners, a User must first register on the website and create an Account.

(b) Users are limited to a single (1) Account on the Site.

(c) When creating an account on the Site, you must provide certain basic information. Each user must choose a username, password, and submit some information, such as their name, email address, and location.

(d) By registering, each User undertakes to provide true, full, and up-to-date information, and to maintain the accuracy, up-to-dateness, and completeness of such information. If Pet Lodger discovers that any information provided by a user is false, out-of-date, or lacking, it maintains the right to suspend or cancel that user's account and restrict access to the site and services.

(e) Our Privacy Policy and Website Terms of Use contain information on how we save and protect your personal information. On occasion, Owner Advertisements or Sitter Profiles with photographs may be used by Pet Lodger on our social media pages for marketing purposes or other purposes. This encompasses Facebook and Instagram, among other platforms.

(f) It is the User's obligation to maintain the confidentiality of its username, password, and account information. All activity on the account, including purchases made with the account information, is the responsibility of the user. In addition to assuming full responsibility for any activities or actions under its Account, whether or not it has given permission for them, the User also promises not to share its password with any outside parties.

(g) Professional home sitters who charge for their services are allowed to register on Pet Lodger, however they must be the only staff member of their company.

(h) If the User discovers any unauthorized use of its Account, it will alert Pet Lodger right away.

4.Sitters and Sitter Profiles

Probdone

Sitters are allowed to create Sitter Profiles if they have already created an Account. The personal data it gives Pet Lodger is used to develop the Sitter Profile for its usage on the Site. The personal email address of the Sitters is not disclosed in the Sitter Profile. The Sitter Profile cannot have any phone numbers, email addresses, surnames, website URLs, or any other identifiable information on it for security, privacy, or safety concerns. Pet Lodger maintains the right to delete any information from a Sitter Profile that we deem inappropriate, including phone numbers, email addresses, surnames, URLs, and website data, at any time and without prior warning.

(b) Every Sitter understands and accepts responsibility for their own Profile, including any problems that might occur from sharing personal information.

(c) In order to offer Sitting Services, Sitters can interact with Owners via the Site.

(a)(d) Any contract that is made between an Owner and a Sitter when the Owner gets in touch with the Sitter to request Sitting Services the agreement does include Pet Lodger as a party.

(e) Every Sitter understands and consents to the risk associated with any communications they may have with other Users. Pet Lodger is unable to confirm the sincerity of other Users' intentions.

(f) Every Sitter is required to notify Pet Lodger of any User demands or actions that are, or that the Sitter has a reasonable suspicion are:

(i) dubious

(ii) incoherent;

(iii) unlawful; or

(iv) probably going to harm Pet Lodger's, the Site's, Services', and/or a User's reputation.

(g) Every Sitter understands and consents that although the Site enables communication between Sitters and Owners, sharing the contact details of other Sitters and Owners is not permitted.

(h) Every Sitter certifies and guarantees that any information it offers and every Sitter Profile it publishes:

(i) will not violate any contracts it has made with other parties;

(ii) will abide by all applicable laws, tax obligations, and guidelines that could be relevant to any User in its nation or locality; and

(iii) won't infringe upon the rights of other people.

(i) To be clear, Pet Lodger disclaims all liability for a User's adherence to any applicable laws, rules, or regulations.

(j) Pet Lodger retains the right, in its sole discretion, to delete or disable access to any Account and/or Sitter Profile for any reason, including Accounts and/or Sitter Profiles that it deems objectionable for any reason, in violation of these Terms, or otherwise detrimental to the Site or Services. This right may be exercised at any time and without prior notice.

5.Owners and Owner Advertisements

(a) Owner Advertisements may be created by Owners who have registered for an Account. The personal data that the owner gives Pet Lodger is used to generate the Owner Advertisements for its use of the Site. The Owner's personal email address is not disclosed on the Profile. The Owner Advertisement may not include any phone numbers, email addresses, surnames, website URLs, or other identifying information for security, privacy, or safety reasons. Pet Lodger retains the right to delete any URL or website information, phone numbers, email addresses, surnames, and any other content from an Owner Advertisements at any time and without prior warning.

(b) When a house is rented or leased, the landlord or any representative they hire must provide their full consent for the tenant to represent them as the owner. According to these terms and conditions, the tenant is therefore considered a "Owner."

(c) Every Owner understands and accepts that it is in charge of its own advertisement, including any problems that might occur from the Owner sharing personal information.

(d) Owners can interact with Sitters through the Site by requesting Sitting Services. Certainly, with prior agreement and arrangement, either a family member or a tenant sharing the house can be considered. In the event that caretaker responsibilities are necessary (such as for AirBNB), the Owner and Sitter will enter into an agreement, and the Sitter will be paid appropriately for these extra services.

(e) Before an agreement is reached, owners must notify Sitters of the presence and location Probdone of any security cameras that are mounted within and outside the house.

(f) Any contract that is made between an Owner and a Sitter when the Owner gets in touch with the Sitter to request Sitting Services belongs to the Owner. The agreement does not include Pet Lodger as a party.

(g) Every Owner understands and consents that any correspondence with another User is done at their own risk. Pet Lodger is unable to confirm the sincerity of other Users' intentions.

(h) Every Owner shall notify Pet Lodger of any User requests or actions that are, or the Owner reasonably assumes to be,

(i) dubious

(ii) incoherent;

(iii) unlawful; or

(iv) probably going to harm Pet Lodger's, the Site's, Services', and/or a User's reputation.

(i) Every Owner understands and consents that although the Site enables communication between Owners and Sitters, Owners are not allowed to exchange Owners' and Sitters' contact details.

(j) Every Owner affirms and guarantees that whatever information they offer, such as any messages they send or Owner Advertisements they publish:

(i) will not violate any contracts it has made with other parties;

(ii) will abide by all applicable laws, tax obligations, and guidelines that could be relevant to any User in its nation or locality; and

(iii) won't infringe upon the rights of other people.

(k) To be clear, Pet Lodger disclaims all liability for a User's adherence to any applicable laws, rules, or regulations.

(l) Without giving prior notice, Pet Lodger retains the right to delete or disable access to any Account and/or Owner Advertisements for any reason, including those that the company, in its sole discretion, deems to be objectionable for any reason, in violation of these Terms, or detrimental to the Site or Services in any other way.

6.Identification Verification

(a) Pet Lodger may provide Sitters with the opportunity to use our third-party ID verification service, Trulioo (ID Verification Service Provider), to confirm their identity and/or validate their account.

The Sitter recognises and consents that, in the event that they have chosen to have their identity confirmed in this way,

(i) To verify the identity and information of the Sitter, Pet Lodger may get in touch, establish a connection, or communicate in any other way with the ID Verification Service Provider; and

(ii) In order to enter the UK, the Sitter must give the ID Verification Service Provider personal information such as their address, driver's licence, passport, and/or visa, and they must give their consent for the ID Verification Service Provider to use this information in order to conduct an identity check.

(C) After an Identity Check is successful, the Sitter certifies and confirms that:

(i) Pet Lodger may allow the Sitter to show that a successful identity check has been completed by Probdone using verification signs or badges in connection with their account (Verification Badge);

(ii) Each Account may only have one Identity Check permitted.

(d) Every User recognises and concur that:

(i) Because the Identity Check and the issue of a Verification Badge rely on information from a Sitter and/or checks carried out by the ID Verification Service Provider, they might not be entirely correct;

(ii) Users should conduct their own investigations into the correctness, legitimacy, validity, reliability, or authenticity of any Users and should not rely on the Identity Checks or Verification Badges;

(iii) Pet Lodger disclaims any representations, warranties, and assurances of any type, whether made expressly or implicitly, or under these Terms, the law, or any other foundation, with regard to or associated with:

(A) the veracity, correctness, legitimacy, authenticity, or validity of any Users;

(B) the completion of any identity verification; or

(C) the awarding of any badge of verification; and

(iv) To the greatest extent allowed by law, Pet Lodger disclaims all liability and accepts no responsibility for Identity Checks, Verification Badges, or any use of or reliance on them, including Verification Badges applied to Accounts for which not all members have undergone verification.

7.Owner Warranties and Representations

Owners affirm and guarantee that, with regard to their house and/or car (if relevant):

(i) The home and vehicle (if applicable) are fully insured and covered by current policies, including insurance against loss, liability, and personal injury to any third party (including Sitters) while they are occupying or using the property, or resulting from an act (or inaction) on the part of any third party (including Sitters) while occupying or using the property, vehicle, or both, during the house sitting period. Keep in mind that local laws pertaining to auto and home insurance (if applicable) may differ. Owners are exclusively in charge of making sure that any insurance is proper and lawful within their respective legal area;

(ii) that all levies, rates, taxes, charges, tolls, and/or tithes that are payable by the Owner are paid for and will be paid for during any period of house sitting. This includes land rates, property taxes, utilities, mortgage payments, body corporate fees, television and radio licences, fire, police, ambulance, and other emergency services levies.

(iii) that before any term of home sitting begins, all fixtures and appliances (as applicable), including smoke alarms where needed by law, are in good operating condition; and

(iv) that it will be liable for and pay for any repairs that must be made to their home and/or car (if applicable) due to normal wear and tear, including any necessary maintenance for any fixtures, appliances, and contents (if applicable).

(b) To be clear, Pet Lodger disclaims all liability and makes no warranties or representations regarding an Owner's compliance with these Terms or with any applicable laws, rules, or regulations, including compliance with the warranties and representations made by them under this clause 7.

8.Sitter Warranties and Representations

(a) House sitters represent and guarantee that, with regard to any residence and/or car (where relevant), they use and occupy during the house sitting period:

(i) that they will take full responsibility for and pay for any necessary repairs to the home and/or car (if applicable) that result from any abuse or neglect, including any fixtures, appliances, and contents, and that they will notify the Owner's agent (Owners Agent) of the need for repairs as soon as possible.

(ii) that they will promptly notify the Owners Agent of any loss, liability, and personal injury that arises to any third party—including themselves—that is occupying or using the house and/or vehicle (if applicable), or that is caused by a third party's act—or inaction—that results in any of these situations during any house-sitting period;

(iii) that they will be in charge of caring for any pets as directed by the owner, including feeding, walking, brushing, cleaning, and, if necessary, transporting the pet(s) to the owner's designated veterinarian;

(iv) that in accordance with their agreements with the Owner, they will be in charge of maintaining any lawns, gardens, and swimming pools;

(v) that they are liable for small expenses, like changing light bulbs, among other things;

(vi) that they will maintain the house and, if appropriate, the car neat, and orderly

(vii) any broken articles should not be swapped out;

(viii) that they will obtain the owner's consent before hosting any guests in the house;

(ix) that, if applicable, they won't sublease or rent out the house or car;

(x) that the house will always be safely locked, as will the car, if relevant;

(xi) that they promise not to take any action, or to permit any third party to take any action, that would nullify or terminate the house and/or auto insurance (if applicable);

(xii) that, if relevant, they won't smoke in their house or car;

(xiii) that any correspondence will be forwarded to the Owners Agent;

(xiv) that they promise to leave the home and, if applicable, the car neat, orderly, and in excellent repair after any house sitting time; and

(b) For the avoidance of doubt, Pet Lodger disclaims all liability and makes no warranties or representations regarding a Sitter's compliance with these Terms or any applicable laws, rules, or regulations, including compliance with the representations and warranties made by them in this clause 8.

9. Additional Warranties and Representations for Vehicles

Owners who let Sitters to utilize their cars for any length of time while house sitting affirm and guarantee Probdone that, in addition to the guarantees and representations mentioned in article 7, the following applies to their car:

(i) that its use satisfies all applicable legal and regulatory requirements;

(ii) that it is operationally sound;

(iii) that a recent service was performed;

(iv) that they will give the Sitter documentation that includes specifics about the vehicle's insurance coverage and registration; and

(v) that they will give the Sitter a list of the small flaws with their cars.

(b) House sitters who utilise one of the Owner's cars while the house is being sat for acknowledge and guarantee the following, in addition to the guarantees and representations mentioned in section 8:

(i) unless otherwise specified in writing, the Sitter will only operate the Owner's car;

(ii) that the Sitter is legally authorised to operate the Owners' car with the necessary permissions and paperwork; and

(iii) that only sealed roads will be used for driving the Owner's vehicle;

(iv) that they will notify the Owners Agent of any accident or mechanical malfunction right away; and

(v) that they will notify the appropriate authorities of any accidents.

(c) For the avoidance of doubt, Pet Lodger disclaims all liability and makes no warranties or representations regarding an Owner's or Sitter's compliance with these Terms, including compliance with the warranties and representations made by them as detailed in this clause 9.

10.Owners Agent

(a) Each Owner is required to designate an Owners Agent and give the Sitter the Owners Agent's contact information.

(b) Regardless of whether the Owner or the Sitter is responsible for the repair costs, the Owners Agent is in charge of and needs to have the authority to approve any repairs to the Owner's home and/or vehicle. In cases where the Sitter bears the financial responsibility for the repairs, an invoice detailing the costs and expenses incurred for the repairs must be furnished by the Owners Agent.

(c) With appropriate notice, sitters will allow the owners' agent to check the house and/or car (where applicable). There is no need to give notification when an emergency calls for an inspection.

(d) To be clear, Pet Lodger disclaims all liability and makes no warranties or representations regarding an Owner's compliance with these Terms or with any applicable laws, rules, or regulations, including compliance with the warranties and representations made by them under this clause 10.

11.Reviews and Ratings

(a) Reviews and ratings can be given by Owners for Sitters, and Sitters can give reviews and/or ratings for Owners (Reviews and Ratings). One Response to a Review and/or Rating that a user receives may be published.

(b) If the house sit assignment has not occurred since the Owner or Sitter cancelled, then a Review and Rating cannot be posted. Such Ratings and/or Reviews may be removed by Pet Lodger.

(c) If an owner contacts you directly without publishing an advertisement, their message, their Sitter profile, and any reviews or ratings they may have received will all be visible to the public. Even if they disagree with the content, users cannot erase a review, rating, or response.

(d) In their Reviews, Ratings, and any related Responses, Owners and Sitters are required to offer truthful, equitable, and accurate information. The opinions expressed in Reviews, Ratings, and related Responses are those of the individual Members and do not represent the views of Pet Lodger.

(e) Pet Lodger reserves the right to remove a review, rating, or response if it reasonably determines that it is false, unfair, inaccurate, offensive, or unsuitable. It is not the responsibility of Pet Lodger to review every review, rating, or response.

(f) To the maximum degree allowed by law, Pet Lodger disclaims all liability for the information contained in any reviews, ratings, or related responses.

12.Payments

(a) The fees listed on our website (Fees) must be paid by sitters.

(b) Owner and Sitter receive different payments.

(c) Despite not having to pay a fee for the Services, Owners understand that by using the Services, they may be charged for the Sitting Services they get, along with any relevant insurance, related fees, and taxes.

(d) By creating an Account, each Sitter consents to pay the applicable Fees in the currency shown on the Site.

(e) A Sitter has the option to pay with a credit card or PayPal for the Services. The money will be transferred right away. The Account won't be created if a Sitter's payment cannot be processed correctly.

(f) Where applicable, Value Added Tax (VAT) shall be assessed.

(g) The Sitter may not use any fraudulent or illegal methods to pay for the Services, nor may they attempt to do so.

(h) All payments are final in the absence of fraud or error, and each Sitter agrees to satisfy all such payments made. The Sitter shall not be entitled to terminate the formation of the Account for any reason.

(i) The Sitter will be notified if Pet Lodger is unable to receive the Subscription Fee in full by the due date for any reason. The Sitter will not be able to access their Account or the Services until Pet Lodger receives the Subscription Fee in full.

(j) If the Sitter uses a debit or credit card to make a payment, the Sitter guarantees that the details supplied to Pet Lodger are true, accurate, and complete; that the Sitter is authorised to use the card issuer's debit or credit card; that the card issuer will honour the payment; and that the Sitter will keep enough money in the account to cover the purchase price.

(k) Pet Lodger is free to take any necessary legal action to recoup any unpaid fees. The Sitter's details may be shared for collection purposes and/or legal action if the Sitter defaults on payment. The Sitter acknowledges and commits to covering all expenses, including commission, debt collection, legal fees, and other out-of-pocket costs. Pet Lodger may file a default against the Sitter with a credit reporting agency if the Sitter ever violates Pet Lodger's payment terms and is consequently forwarded for collection and/or legal action.

(l) At its sole discretion, Pet Lodger may periodically change its prices or payment options.

13.Offers and Promotions

(a) may occasionally run promotions or offers that might be relevant to the Services.

(b) The terms and conditions of these promotions or offers shall be listed on the website.

(c) By using any offer or promotion, the user understands and Probdone accepts that Pet Lodger may, in its sole discretion, remove or extend it. Pet Lodger assumes no liability or responsibility for any potential loss or damage the user may suffer as a result of this action.

14.Reward Credits

(a) Pet Lodger has the right to give Sitters reward credits to apply towards the payment of their fees.

(b) Sitters can accrue Reward Credits in the ways specified on our website, which may include, but are not restricted to:

(i) obtaining the Membership Badge (described below); and

(ii) suggesting a buddy who joins the Sitter community.

(c) Reward credits are automatically applied to lower the cost of a Sitter's subsequent subscription fee when they are credited to their account.

(d) Reward credits cannot be redeemed or transferred.

(e) In the event that a Sitter earns a Reward Credit but their Account membership has lapsed, the Reward Credit will stay on the Account until the Sitter re-establishes their Account membership. The re-establishment fee will thereafter be credited to the Reward Credit.

(f) At its sole discretion, Pet Lodger reserves the right to change the structure and procedures pertaining to Rewards Credits and Membership Badges at any moment.

15.Membership Badges

(a) The Owner or Sitter may receive Membership Badges that indicate the duration of their affiliation with Pet Lodger.

(b) As stated on our website, the Sitter may receive Reward Credits for obtaining Membership Badges.

16.Dispute Resolution

(a) In the event of a disagreement between an Owner and a Sitter, we advise both parties to make a sincere effort to settle their differences directly and through channels not connected to the Site, including demands for refunds. If a disagreement cannot be settled by these methods, Owners and Sitters may ask Pet Lodger for assistance, and we may provide it at our discretion in line with clause 17. As an alternative, Users may decide to settle the disagreement in a way that was mutually agreed upon or in a way that complies with the law.

(b) Pet Lodger encourages its Users to provide comments regarding the Services. Pet Lodger aims to promptly and efficiently address any concerns regarding the Services. Please contact any staff member with any questions or comments you may have on the Services.

(c) Neither Pet Lodger nor the User may file a lawsuit pertaining to a dispute, controversy, or claim arising from, or in connection with, these Terms (including any question regarding its existence, validity, or termination) (Dispute) without first meeting (including electronically) with a senior representative of the other party to attempt (in good faith) to resolve the Dispute. Either Pet Lodger or the User may take the dispute to a mediator if the parties are unable to reach a resolution at that first meeting. Any party may request that a mediator be appointed by the appropriate local service if the parties are unable to agree on a mediator. The rules, venue, and time of the mediation will be determined by the mediator. In an effort to settle the dispute, the parties’ consent to participate in the mediation in good faith. The parties shall evenly split the mediation's expenses. Nothing in this paragraph will prevent a party from requesting equitable or urgent injunctive relief from a court with the proper authority.

17.Complaints Procedure

(a) Should a disagreement arise between Users of the Site, any User may ask Pet Lodger for help in settling the issue; Pet Lodger may provide assistance in its discretion.

(b) After taking into account the data submitted, Pet Lodger will decide, at its sole discretion, if it needs to take any further action.

(c) Pet Lodger has the right to notify Users of concerns and ask them to respond.

(d) In order to help Pet Lodger resolve conflicts with other Users, Users agree to cooperate with the company and answer to reasonable requests for information.

(e) If a user's complaint is judged to be of a serious nature during the inquiry, Pet Lodger retains the right to disable that user's account until that user responds.

(f) Using the information supplied, Pet Lodger may recommend a course of action to Users in an attempt to settle a dispute.

(g) At any moment, Pet Lodger retains the sole right to decide that a User is no longer fit to be a User and that they will not be allowed to use the Site or the Services; in such case, the User's Account will be terminated.

(h) Pet Lodger may notify other users when a user's account is cancelled, but it will not divulge the specifics of any dispute.

(i) Pet Lodger encourages Users to settle disputes amongst themselves if a User is dissatisfied with Pet Lodger 's response or wishes to remove Pet Lodger from the disagreement.

(j) To be clear, Pet Lodger does not represent itself as a mediator or arbitrator and does not make any claims or promises regarding the settlement of any disputes between Users, including whether a User will receive compensation in connection with a dispute.

18. Cancellation of Registration

(a) A User must send an email to Info@petlodger.co.uk in order to cancel their account. Through the Site, users can also delete their accounts at any time.

(b) If you have to cancel, there won't be any refunds.

19.Consumer Guarantees

(a) Guarantees against exclusion, restriction, or modification are provided to consumers by consumer legislation in the United Kingdom, particularly the Consumer Rights Act (Rights). Other nations with comparable consumer protection laws and regulations might offer comparable promises to their customers.

20.Intellectual Property

(a) All logos, slogans, content, designs, diagrams, drawings, graphics, images, layouts, appearance, Probdone videos, ideas, methods, databases, codes, algorithms, software, fees, pricing, notes, documents, domain names, confidential information, copyright, rights in circuit layouts (or similar rights), registered or unregistered trademarks, trade names, patent, know-how, trade secret and any other intellectual or industrial property whether such rights are capable of being registered or not (collectively Intellectual Property), including but not limited to copyright which subsists in all creative and literary works displayed on the Site and Services, the layout, appearance and look of the Site, together with any applications for registration and any rights to registration or renewal of such rights anywhere in the world, whether created before or after the date of these Terms and whether used or contained in the Site is owned, controlled or licensed to Pet Lodger (or its affiliates and/or third party licensors as applicable)

(b) The User acknowledges and accepts that nothing in these Terms represents a transfer of any Intellectual Property and that, as between the User and Pet Lodger, Pet Lodger owns or has the appropriate licence for all Intellectual Property rights in the Site and Services. The copyright, trademark, patent, trade secret, international treaties, laws, and other proprietary or industrial rights—regardless of whether they can be registered—protect the intellectual property, the site, and the services. Security features that safeguard digital information only when authorised by Pet Lodger or the content owner may also be present.

(c) A portion of the intellectual property utilised in relation to the website and services is comprised of trademarks belonging to the respective owners, referred to as third party marks.

(d) Without the prior written consent of Pet Lodger, the relevant trademark holder, or the owner of intellectual property, no part of Pet Lodger's intellectual property may be duplicated, imitated, or utilised.

(e) Without the prior written consent of Pet Lodger or the relevant intellectual property owner, users of the site are not granted any interest in or licence over the intellectual property or Third Party Marks. Users are not allowed to do any actions that infringe upon or violate intellectual property rights.

21.User Licence

(a) In compliance with these terms, Pet Lodger grants the User a limited, revocable, personal, non-exclusive, and non-transferable licence to use the Site and Services solely for its own personal and/or non-commercial use on a computer or mobile device that the User owns or controls as allowed by these terms (the "User Licence"). Other than in compliance with local fair dealing laws in accordance with the Copyright, Designs, and Patents Act 1988, the User may not use the Site and Services in any other capacity. Without the previous written authorization of Pet Lodger, all other uses are banned.

(b) The User is not purchasing the right to use the Site and Services; rather, the User is granted a license to do so. further than using the Site and Services in compliance with these Terms, a User has no further rights.

(c) Unless other Terms accompany such updates, supplements, or replacements, in which case the separate Terms will apply, this Agreement and User Licence controls any updates, supplements, or replacements for the Site and Services.

22.Permitted and Prohibited Conduct

(a) The User is solely in charge of adhering to all laws, rules, and regulations, including any applicable tax responsibilities, in connection with its use of the Site and Services. Regarding the User's usage of the Site and Services, the User acknowledges and undertakes not to:

(i) utilize the Site or Services for any other or commercial use not specifically allowed by these Terms;

(ii) create multiple accounts or register for an account on someone else's or an entity's behalf;

(iii) use the Services to locate a Sitter and then use them to complete, help someone else complete, or conduct transactions outside of the Services to avoid having to pay any fees associated with Pet Lodger providing the Services;

(iv) post, upload, or review anything that is objectionable, contains language that is inappropriate or nude, rants about race or religion, is discriminatory, or disparages another user, Sitter profile, or Owner Advertisements;

(v) provide any inaccurate or deceptive information

(vi) offer any sitting services as a Sitter that it is unable or does not intend to fulfill;

(vii) make any proposals to the Sitter as an Owner that it does not plan to accept;

(viii) disobey any ordinance or court order, whether municipal, state, federal, provincial, or otherwise applicable; this includes, but is not limited to, zoning laws and tax laws;

(ix) use any content or information on the Site or Services for any kind of copying, storing, or accessing that isn't specifically allowed by these Terms;

(x) violate the rights of any individual or organization, including but not limited to their contractual, intellectual property, privacy, or publicity rights;

(xi) communicate, distribute, post, or submit any information on any other person or entity using the site or services; this includes, but is not limited to, images of others taken without their consent, contact details for individuals, and credit, debit, calling, or account numbers;

(xii) use the website or services to disseminate unsolicited commercial emails, such as spam or adverts;

(xiii) gather or retain any personally identifying information about another user other than for the purpose of completing transactions as a User on the Site, or harass or stalk any other user of the Services;

(xiv) without the express written consent of Pet Lodger, use, display, mirror, or frame the Site, or any specific element within the Site, Services, Pet Lodger 's name, any Pet Lodger trademark, logo, or other Intellectual Property, information, or the layout and design of any page or form contained on a page; or

(xv) support, motivate, or help a third person carry out any of the aforementioned actions.

23. Content

(a) Copyright, trademark, and other laws of the United Kingdom and other nations protect the Site, Services, and Intellectual Property. The User understands and accepts that Pet Lodger and its licensors are the only owners of the Site, Services, and Intellectual Property, including all related intellectual property rights. Any copyright, trademark, service mark, or other proprietary rights notice included in or accompanying the Site and Services, or Intellectual Property, shall not be removed, altered, or obscured by the User.

(b) Nothing that the user uploads, publishes, submits, transmits, or posts may be used to:

(i) breaches or infringes upon the patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights of third parties, as well as their rights to publicity or privacy;

(ii) is dishonest, fabricated, deceptive, or fraudulent;

(iii) disparages an Owner, a Sitter, the Site, Services, or Pet Lodger;

(iv) transgresses any applicable laws or regulations or encourages behavior that could do so or result in civil responsibility;

(v) is offensive, vulgar, obscene, pornographic, defamatory, and encourages bigotry, racism, discrimination, hatred, harassment, or injury to any person or group;

(vi) engages in violent or menacing behavior or encourages behavior that poses a harm to others; or

(vii) encourages the use of dangerous or illicit substances or activities.

24.User Content

(a) Users are allowed to send, upload, publish, submit, and post pertinent data and material (User Content). The User grants Pet Lodger a worldwide, irreversible, perpetual, non-exclusive, transferable, royalty-free license to use any User Content and Intellectual Property that the User makes available on or through the Site and Services. This license includes the ability to use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, and otherwise exploit such User Content and Intellectual Property on, through, or by means of the Site and Services

(b) By using the Site and Services, the User acknowledges that it is entirely liable for all User Content and Intellectual Property. The user affirms and guarantees that:

(i) it has all the rights, licenses, consents, and releases required to grant Pet Lodger the rights in such User Content or Intellectual Property, as contemplated under these Terms, or it is the sole and exclusive owner of all User Content and Intellectual Property that it makes available through the Site and Services; and

(ii) This User Content, its posting, uploading, publication, submission, transmission, or use of the User Content (or any portion thereof) on, through, or by means of the Site and the Services by Pet Lodger shall not infringe, misappropriate, or violate any patent, copyright, trademark, trade secret, moral rights, or other Intellectual Property rights of third parties, or cause a violation of any applicable law or regulation.

(c) Any inappropriate or unlawful User Content may be removed by Pet Lodger at its sole discretion.

25.Disclaimers

(a) Neither Pet Lodger nor any of its affiliates warrant that any Owner will request Sitting Services or that Owners will be able to locate suitable Sitters and/or Sitting Services.

(b) No Owner, Sitter, Sitter Profile, Owner Advertisements, or Sitting Service is endorsed by Pet Lodger. Owners and Sitters are required by Pet Lodger to attest to the accuracy of the information they have provided. Pet Lodger does not verify the identity of any Owner or Sitter, Sitter Profile, Owner Advertisements, or Sitting Services, nor does it run any kind of background check on Owners or Sitters.

(c) Neither the condition, legality, or suitability of any Sitter or Sitting Services, nor the content of any Owner Advertisements, Sitter Profiles, or messages submitted via the website are under the responsibility of Pet Lodger. Owners bear the responsibility of ascertaining the identification and appropriateness of Sitters they communicate with through the Services, and Sitters must ascertain the identity and appropriateness of any Owner they communicate with through the Services.

(d) Regarding the dependability, accuracy, and comprehensiveness of the information on the Site, Pet Lodger disclaims all duty and makes no guarantees or assurances to the User or any other person or entity. All liability pertaining to owners, sitters, sitter profiles, Owner Advertisements, and sitting services is disclaimed by Pet Lodger.

(e) Before providing the sitting services, Pet Lodger advises all Owners to verify the identity of the Sitter. It is also advised by Pet Lodger that before providing any sitting services, Sitters take reasonable steps to confirm the identity of any owners.

(f) By accessing the Site or Services, the User acknowledges and agrees that the only available legal recourse or liability for any acts or omissions by other Owners, Sitters, or third parties will be a claim against the Owner, Sitter, or other third party that harmed the User. In order to settle any disagreements or concerns about communications or arrangements made between them, Pet Lodger advises Users to get in touch with the appropriate Owner or Sitter directly through the Site and Services.

(g) To the greatest extent permitted by applicable law, Pet Lodger disclaims all express and implied warranties, representations, and conditions, including those pertaining to the merchantability, satisfactory quality, accuracy, completeness, reliability, suitability for a particular purpose or need, non-infringement, and lack of defects or errors of the Site or Services.

(h) To be clear, Pet Lodger is not liable for any taxes, tariffs, fees, immigration, or visa issues related to these terms. All users of the Site and Services are advised by Pet Lodger to seek counsel on these topics.

(i) Use of the Site and Services is at the Owners' and Sitters' own risk.

(j) To the maximum extent allowed by law, Pet Lodger disclaims all express and implied terms, conditions, and guarantees, including but not limited to:

(i) Except as provided in these Terms, Pet Lodger hereby expressly Probdone disclaims all implied and express promises, warranties, representations, and conditions of any kind;

(ii) Pet Lodger disclaims all warranties regarding the Site, the Services, the Content (including images, videos, sound clips, links, and the like), and the User's access to the Site and the Services; in addition, it makes no guarantees regarding the correction of errors or the absence of viruses or other harmful elements on the Site or the server that hosts and transmits material to the User;

(iii) Pet Lodger disclaims all liability and assumes no responsibility for the Site, Services, Owner, Sitter, and Sitting Services being unavailable, not meeting a certain level of workmanship, not meeting the requirements of the User, not meeting the Owner Advertisements description, not meeting the Sitter Profile description, or not being of merchantable quality; and

(iv) Pet Lodger will not be liable for any loss, damage, costs or expense whether direct, indirect, incidental, special, consequential and/or incidental, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal, bodily injury, death or emotional distress, loss of revenue, production, opportunity, access to markets, goodwill, reputation, use or any indirect, remote, abnormal or unforeseeable loss, or any loss or damage relating to business interruption, loss of programs or other data on the User’s information systems or costs of replacement goods, or otherwise, suffered by the User or claims made against the User, arising out of or in connection with the Site, Services, content on the Site, inability to access or use the Site, the Services, any Sitter Profile, any Owner Advertisements, the Sitting Services, or the Terms, even if Pet Lodger was expressly advised of the likelihood of such loss or damage.

(k) In relation to such acts or omissions, the User undertakes not to attempt to hold Pet Lodger liable or pursue any legal remedies.

26.Limitation of Liability

(a) The entire liability of Pet Lodger arising out of or related to the Site, the Services, or the Terms, however arising, will not exceed the total fees paid by the User to Pet Lodger in the twelve (12) months prior to the event giving rise to the liability, or fifty pounds (GBP£50) if no such payments have been made, as applicable. This limitation applies to all theories of liability, including contract, tort, including negligence, in equity, under statute, or otherwise.

(b) The above-mentioned damage limitations form an integral part of the agreement between Pet Lodger and the User. The above limitation might not apply to the User because certain countries do not provide the exclusion or limitation of liability for consequential or incidental damages.

(c) The parties' sharing of the risk is reflected in this liability restriction. Even in the event that it is determined that any limited remedy mentioned in these conditions has not served its intended purpose, the limitations outlined in this section will still be in effect. Pet Lodger benefits from the responsibility limitations outlined in these agreements.

27.Indemnity

Every User undertakes to defend, indemnify, and hold harmless Pet Lodger (and Pet Lodger 's parent, related bodies corporate, officers, directors, contractors, employees, and agents) from and against any claims, actions, suits, demands, damages, liabilities, costs or expenses (including legal costs and expenses on a full indemnity basis), including in tort, contract, or negligence, arising out of or connected to the User's use of or access to the Services; any breach of these Terms by the User; any willful, unlawful, or negligent act or omission on the Part of the User; and any infringement by the User of any applicable laws or the rights of any third party.

(b) Pet Lodger retains the right to take exclusive defense and management of any other claim, unless the User provides indemnification; in that case, the User will assist in raising any defenses that may be available.

(c) These Terms, as well as the User's use of the Site or Services, shall survive the defense and indemnity obligations herein. The User may not transfer or assign these Terms or any rights and licenses granted hereunder, but Pet Lodger may assign them without restriction.

28.General

(a) Accuracy: Pet Lodger makes no express or implied representations, warranties, or guarantees regarding the completeness, accuracy, reliability, suitability, or availability of any information, images, products, services, or related graphics contained on the Site for any particular purpose, even though Pet Lodger will make an effort to keep the information current and accurate. The User hereby agrees that, to the maximum extent permitted by law, Pet Lodger expressly disclaims all liability for any mistakes, inaccuracies, or errors in such information and materials.

(a) Security: On our systems, Pet Lodger does not handle or keep credit card information. A protected third-party processor that complies with Level 1 PCI DSS handles all credit card payments.

(c) Termination: Without incurring any obligation to the User, Pet Lodger retains the right, in its sole discretion, to refuse the provision of the Services requested by any User, to terminate any User's Account, to cancel its contract with any User, and to remove or edit any content on the Site. Any of the following could happen if Pet Lodger decides to cancel a user's account, either with or without the user being informed: In the event that the User's Account is suspended, deactivated, or terminated, the following will happen: (a) the User's Account will be blocked from accessing the Site, Services, Account, or User Content; (b) any Owner Advertisements or Sitter Profiles (if applicable) will be terminated immediately; (c) Pet Lodger may, in its sole discretion, refund the Sitter in full; and (e) the User will not be entitled to any compensation.

(d) Fraudulent Activities: Each User acknowledges and agrees that Pet Lodger retains the right to immediately terminate any Accounts involved in fraudulent activities, contact the appropriate authorities, and provide all information required to assist in proceedings and investigations in the event that Pet Lodger reasonably suspects that fraudulent activities are occurring within the Site and Services.

(e) Force Majeure: If a delay results from an event beyond Pet Lodger 's reasonable control, it will not be held responsible for any delay or failure to comply under the Terms.

(f) Notice: If a notice is sent in writing and delivered in person, by email, or by post to the party to whom it is intended, or to any other address or email address that the other party may occasionally be notified in writing of, it shall be deemed to have been duly given with respect to the Terms.

(g) Waiver: Neither party's failure to require the other to strictly abide by any term of the Terms shall be construed as a waiver Probdone of any rights that the other party may have now or in the future with regard to that provision. If Pet Lodger does not explicitly specify in writing that a waiver of any of the Terms has been granted, Pet Lodger's waiver of any such term will not take effect.

(h) Assignment: Without Pet Lodger's prior written consent, a User may not assign any rights or obligations under the Terms, in whole or in part.

(i) Severability: Any term, condition, or provision that is found to be invalid, unlawful, or unenforceable in any way by a competent authority will be severed from the remaining terms, conditions, and provisions, which will remain valid to the maximum extent allowed by law.

(j) Jurisdiction and Applicable Law: The laws of London, England shall apply to these Terms, to the use of this Site and the Services, and to any dispute arising out of any User's use of the Site or Services. The London courts shall have exclusive jurisdiction over any such issue. You can visit the Site from anywhere in the United Kingdom as well as abroad. Pet Lodger disclaims any liability regarding the Site's content's compliance with intellectual property laws and other laws of any nation other than the United Kingdom. When a User accesses the Site from outside of the United Kingdom, they do so at their own risk and are in charge of abiding by local laws in that location.

(k) Entire Agreement: These Terms and any document specifically referred to in them constitute the complete understanding and agreement between Pet Lodger and each User, and they take precedence over any prior oral or written understandings or agreements.
